ABSTRACT Post-truth, understood as a turn from collective sense and judgment to nonpublic forms of epistemic justification, is a distinctly rhetorical problem. This article offers, in response, a theorization of knowledge making as the means by which affective and material impingements upon bodies become publicly legible and rhetorically available. For this, the author turns, perhaps unexpectedly, to John Locke. Locke’s works offer the foundations of an empirical theory of rhetoric that embraces the sensible realm not as a conduit to reality (...) but as a space where social connection becomes possible. Locke engages this realm through natural historical inquiry. Tracing this inquiry to his commonplacing practices, the author presents the rhetorical-dialectical topics as a basis for the shared sense and judgment that he pursued and that post-truth demands. The topics, this article argues, guide and enlarge the senses, forming objects of knowledge with which to sustain public life—objects about which plural truths are possible. (shrink)

Three (...) months later, as a Navy Family Physician, I deployed with a surgical company in support of Operation Iraqi Freedom. Reflecting on the situation with a like-minded close friend, I was not sure— would this be a just war? A necessary war? In my mind, it did not rise to the level of conscientious objection, yet the rightness of invading another country with all the anticipated death and destruction was not clear.En route to Kuwait, we laid over in Spain. While fixed to a TV in a holding area, I watched the Secretary of State make a case to the United Nations (UN) and the world that removing Hussein from power would protect us from mobile anthrax labs that could kill tens of thousands. I thought to myself, Either he is absolutely right, and we are protecting our country and the rest of the free world, or he is terribly mistaken and we are embarking on a disaster.As we trained, prepared, and waited in our tents to invade, we listened to the news on “Voice of America” with a hand crank radio. Thousands of citizens from nations around the world protested. Pope John Paul II, a man well acquainted with the tragedy of war, even spoke out about the planned invasion. “War is not inevitable. It is always a defeat for humanity.” He admonished our leaders that war needed to be the very last option. As a man of faith, I was troubled by his resolute, thoughtful opposition to the crusade I was embarking on. Grâce à cette hypothèse, la causalité, le miracle, la prévoyance de l'avenir, s'expliquent plausiblement. 본고는 반성에 대한 리오타르의 후기 저작 두 가지를 논한다. 리오타르는 그의 칸트 독해에서 반성 개념에 대해 논한 바 있다. 본고는 그 중 칸트의 숭고미에 대하여 를 리오타르의 보다 이전의 저술인 비인간 에 포함된 에세이, “Si l’on peut penser sans corps” 와 관련하여 논한다. 이는 칸트의 반성에 대한 리오타르의 보다 자세한 논의인 칸트의 숭고미에 대하여 를 보다 넓은 차원에서 이해하고자 하는 시도이다. 이를 위해 본고는 후기 리오타르 사상에서 주요하게 등장하는, 사유와 신체 모두와 연관을 맺는 정념 개념에 주목한다.

In After the Rights Revolution, Cass Sunstein confronts the ?Chicago? intellectual tradition on the effects of government regulation. While recognizing the many failures of regulation, Sunstein argues that most regulation serves a potentially useful purpose and that the courts can be relied on to correct the worst regulatory failures. He offers a dizzying array of prescriptions to ensure this outcome, many of which would appear to run afoul of clear congressional intent. In a more recent book, Breaking the Vicious Circle, (...) Stephen Breyer offers a different diagnosis. He sees health?safety?environmental regulation as essentially out of control because of the ?vicious circle? created by irrational and ineffective government responses to the public's concern about the risk of exposure to carcinogens. Breyer does not believe that this vicious circle of excessive and irrational regulation can be broken by the courts. Instead, he suggests the creation of an elite bureaucratic corps with the mission of proposing more effective and less costly approaches to controlling threats to human health. (shrink)

Paul Ricœur’s recourse to the metahistorical categories, space of experience and horizon of expectation, invites an inquiry into geography’s role as the guarantor of history. The ontology of the flesh provides the first indication of how one’s body is implicated in the sense of one’s place in the world. In turn, narrative inscriptions of events on the landscape transform the physical topography of a place into an array of sites where memories of ancestral wisdom and historical traumas endure. By anchoring (...) historians’ representations of the past in the places and locales in which events took place, geography constructs a third space analogous to the third time of history. The aporias engendered by the phenomenology of time, however, have no equivalent in the phenomenology of space. The dissymmetry between the dialectic that informs the discourse of space and the one that informs the discourse of time thus keeps in place the reciprocal relation between geography and historiography. René Descartes comme un philosophe s'est mis en question d'instituer le système comprenant la description complèté du monde des phénomènes physiques, y compris celui des organismes vivants. Au debut de la réalisation son dessein, cette description intitulée «Le Monde» devait se composer de six parties dont deux derniéres avaient pour but de toucher le probléme qui nous interesse particuliérement. Pourtant Descartes n'a pas réussi à réaliser son dessein dans un seul ouvrage. Il a laissé deux traités rédigés indépéndamment et intitulés (...) «L'homme» et «La description du corps humain». Ses dissertations sont devenues une source inspiratice pour nos médiations. Mais ce qui nous prèoccupe particulièrement c'est la façon d'interpréter par Descartes des phénoménes de la vie, largement conçus dans la cadre de la philosophie mécanique. Cette philosophie réduit le monde des phénoménes extérieurs à une seule substance soumise aux lois du mouvement. On s'interroge egalement si l'analogie entre un mécanisme et un organisme pourtrait s'entretenir à la base de la mème pensée, réalisée par Descartes. Aussi, on réflechit à la question si l'on peut accorder au monde réduit aux lois du mouvement et à l'extension, un attribut de la vie, considéré comme le seul phénoméne de son genre. (shrink)

Cette théorie doit fournir des critères intersubjectifs, basés sur l’observation du comportement, les propriétés physiques ou (...) quelque chose de cette sorte. En bref : (C) Pour qu’un sujet S puisse établir si une autre entité W est consciente, il doit faire appel à une théorie empirique proposant un critère d’un point de vue à la troisième personne pour l’attribution de la conscience. Il n’est pas possible de prouver que la conscience est un phénomène réel, mais les éliminativistes ne peuvent pas prouver non plus que ce ne soit pas le cas. Pour le réaliste, la conscience est donnée comme un fait brut, alors que pour l’éliminativiste l’existence de la conscience est une affirmation théorique. J’adhère à une vision réaliste de la conscience, supportée par le fait qu’il me semble vraiment que j’ai des expériences phénoménales, et par l’idée que la dichotomie réalité/ apparence ne s’applique pas aux contenus phénoménaux. Il y a manifestement des corrélations entre les phénomènes physiques et mentaux, qui donnent de bonnes raisons de croire qu’il y a des relations causales entre le monde physique (y compris le corps) et les esprits (conscients). Le dualisme des substances, le dualisme des propriétés, l’épiphénoménalisme et le panpsychisme ne parviennent pas à fournir une explication convaincante de ces corrélations. In De interpretatione 9, Aristotle argues against the fatalist view that if statements about future contingent singular events (e.g. ‘There will be a sea battle tomorrow,’ ‘There will not be a sea battle tomorrow’) are already true or false, then the events to which those statements refer will necessarily occur or necessarily not occur. Scholars have generally held that, to refute this argument, Aristotle allows that future contingent statements are exempt from either the principle of bivalence, or the law of (...) excluded middle. This paper offers a new interpretation of Aristotle’s refutation of fatalism. According to this interpretation, each member of a pair of contradictory future contingent statements, in virtue of expressing modal necessity, is simply false. (shrink)

Whitaker presents the first systematic study of this work, and offers a radical new view of its aims, its structure, and its place in Aristotle's system, basing this view upon a detailed chapter-by-chapter analysis.By treating the work systematically, rather than concentrating on certain selected passages, Whitaker is able to show that, contrary to traditional opinion, it forms (...) an organized and coherent whole. He argues that the De Interpretatione is intended to provide the underpinning for dialectic, the system of argument by question and answer set out in Aristotle's Topics; and he rejects the traditional view that the De Interpretatione concerns the assertion and is oriented towards the formal logic of the Prior Analytics. Kant’s formula of universal law (FUL) is standardly understood as a test of the moral permissibility of an agent’s maxim: maxims which pass the test are morally neutral, and so permissible, while those which do not are morally impermissible. In contrast, I argue that the FUL tests whether a maxim is the cause or determining ground of an action at all. According to Kant’s general account of causality, nothing can be a cause of some effect unless there is a law-like (...) relation between the putative cause and effect. Applied to the case of action, no maxim can be the cause of an agent’s action unless there is a law-like relation between maxims of that kind and actions of that kind. The special capacity to act according to maxims as law-like causes is what Kant calls a will; the basic constitutive principle of the will is a non-normative principle I call the categorical declarative. While the actions of a perfectly good will would be described by the categorical declarative alone, human action is determined not only by the causality of the will, but also by competing causes, namely those stemming from inclination. There is thus need for a causal test for putative maxims. The test contained in the FUL is meant to determine whether an action could be grounded solely on the agent’s maxim, or whether it requires a cause external to the will. This account permits one to build eventual distinctions concerning the morality of actions on prior and independent distinctions concerning their causality. (shrink)

Recently, Australia became the second jurisdiction worldwide to legalize the use of mitochondrial donation technology. The Mitochondrial Donation Law Reform (Maeve’s Law) Bill 2021 allows individuals with a family history of mitochondrial disease to access assisted reproductive techniques that prevent the inheritance of mitochondrial disease. Using inductive content analysis, we assessed submissions sent to the Senate Committee as part of a programme of scientific inquiry and public consultation that informed drafting of the Bill. These submissions discussed a range of bioethical (...) and legal considerations of central importance to the political debate. Significantly, submissions from those with a first-hand experience of mitochondrial disease, including clinicians and those with a family history of mitochondrial disease, were in strong support of this legislation. Those in support of the Bill commended the two-staged approach and rigorous licencing requirements as part of the Bill’s implementation strategy. Submissions which outlined arguments against the legislation either opposed the use of these techniques in general or opposed aspects of the implementation strategy in Australia. These findings offer a window into the ethical arguments and perspectives that matter most to those Australians who took part in the Senate inquiry into mitochondrial donation. The insights garnered from these submissions may be used to help refine policy and guidelines as the field progresses. (shrink)

This third edition of The Infinite includes a new part 'Infinity Superseded' which contains two new chapters refining Moore's ideas through a re-examination of the ideas of Spinoza, Hegel, and Nietzsche. How reasonable and rational can science be when its practitioners speak of "revolutions" in their thinking and extol certain theories for their "beauty"? James W. McAllister addresses this question with the first systematic study of the aesthetic evaluations that scientists pass on their theories. P. A. M. Dirac explained why he embraced relativity by saying, "It is the essential beauty of the theory which I feel is the real reason for believing in it." Dirac's claim seems to belie rationalist accounts (...) of science. Using this and a wealth of other historical examples, McAllister explains how scientists' aesthetic preferences are influenced by the empirical track record of theories, describes the origin and development of aesthetic styles of theorizing, and reconsiders whether simplicity is an empirical or an aesthetic virtue of theories. McAllister then advances an innovative model of scientific revolutions, in opposition to that of Thomas S. Kuhn. Three detailed studies demonstrate the interconnection of empirical performance, beauty, and revolution. One examines the impact of new construction materials on the history of architecture. Another reexamines the transition from the Ptolemaic system to Kepler's theory in planetary astronomy, and the third documents the rise of relativity and quantum theory in the twentieth century. When making a moral judgment, people largely care about two factors: Who did it (causal responsibility), and did they intend to (intention)? Since Piaget's seminal studies, we have known that as children mature, they gradually place greater emphasis on intention, and less on mere bad outcomes, when making moral judgments. Today, we know that this developmental shift has several signature properties. Recently, it has been shown that when adults make moral judgments under cognitive load, they exhibit a pattern similar to (...) young children; that is, their judgments become notably more outcome based. Here, we show that all of the same signature properties that accompany the outcome‐to‐intent shift in childhood characterize the “intent‐to‐outcome” shift obtained under cognitive load in adults. These findings hold important implications for current theories of moral judgment. (shrink)

The large cardinal hypothesis on \(\lambda \) is necessary. We demonstrate this by constructing via forcing two models in which \(\kappa \) is supercompact and \(\kappa \) exhibits an indestructibility property slightly weaker than full indestructibility but sufficient to infer that \(A_0\) is unbounded in \(\kappa \) if \(\lambda > \kappa \) is measurable. In one of these models, for every measurable cardinal \(\delta \), the Mitchell ordering of normal measures over \(\delta \) is linear. In the other of these models, for every measurable cardinal \(\delta \), the Mitchell ordering of normal measures over \(\delta \) is nonlinear. (shrink)

Powered by the injection of fresh ideas from the field of Quantum Information and Computation, the foundations of Quantum Mechanics are in the midst of a renaissance. The variety and number of different approaches, however, makes it challenging for a newcomer to obtain a big picture of the field and of its high-level goals. Awarding rights to rivers, forests, and other environmental entities (EEs) is a new and increasingly popular approach to environmental protection. The distinctive feature of such rights of nature (RoN) legislation is that direct duties are owed to the EEs. This paper presents a novel rebuttal of the strongest argument against RoN: the no interest argument. The crux of this argument is that because EEs are not sentient, they cannot possess the kinds of interests necessary to ground direct duties. Therefore, they (...) cannot be legitimate rights-bearers. After considering and rejecting standard responses to this argument, the paper challenges its fundamental assumption: that rights-correlative duties must be grounded in the interests of the rights-bearer. The paper then presents the RoN critic with a dilemma. The critic must either accept that EEs are legitimate rights-bearers, or delegitimise many well-established rights-bearers along with EEs. Either way, the no interest argument loses its force. (shrink)
